How do you know when to pull a pin?

Litigation is a bit like life, in that you never know what is around the next corner. Whether you are dealing with a recovery or a settlement matter, at some stage you may be faced with making a decision not to proceed further.

Knowing when to make a commercial decision on a file is crucial and getting to that point takes a thorough investigation of the issues and facts. “Throwing good money after bad” does not benefit your client.

What is the service that the client is buying?

Clients instruct you as they are seeking your advice on a matter. Therefore, it is your role to provide it rather than to “sit on the fence”. It is your task to provide a reasoned and structured advice, which leads to a well thought out conclusion, which assists your client in making their decision in providing you instructions.
