Spencer is an experienced insurance litigation lawyer handling complex liability, indemnity and property recovery litigated disputes for national motor vehicle, construction, plant, commercial property and home insurers.
Spencer prides himself on developing and implementing early strategies to any litigation whilst always maintaining a clear focus on obtaining excellent outcomes and adding value to the client.
Spencer has developed an expertise in the defence of credit hire claims. He works closely with insurers training their staff and developing and implementing preventative strategies to reduce an insurer’s exposure and to ensure insurers are availing themselves of all possible defences, in what has become a problematic area for the insurance industry.
Spencer is regularly asked to provide advice on policy interpretation and indemnity where there is suspected fraud, non-disclosure and breaches of a policy. Spencer uses his in depth understanding of the mechanics of policies of insurance, how Courts have interpreted insuring and exclusion clauses and the interplay with the Insurance Contracts Act when providing advice.
Spencer is known for harnessing his in-depth understanding of the Australian Consumer Law to secure recoveries in complex product liability claims brought against manufacturers who have supplied defective goods. Such claims can often represent missed recovery opportunities where insurers may not have otherwise identified recovery potential.
